1. General terms
This document is a public offer by zharkov.dev to enter into a service agreement for the development services and digital products listed on zharkov.dev. Paying an invoice or confirming an order in writing via Telegram or email constitutes acceptance of this offer.
The scope of every order is fixed in a quote and a specification before work starts. Work outside the fixed scope is agreed and paid separately.
2. Services and fixed packages
Base package prices are published on the site and do not change while the fixed scope is being delivered. Add-on options have fixed prices listed in the calculator.

3. Payment
- Development services: 50/50 split — 50% up front after the quote is approved, 50% after the finished project is accepted.
- Lead databases: 100% prepayment. An invoice is issued after the order is confirmed via Telegram or email.
- Payment by invoice or payment link; for international clients — Payoneer or SWIFT. Prices are in US dollars; payments in Ukraine are made in the hryvnia equivalent.
4. Guarantees
- Deadlines: if we miss the deadline fixed in the contract (72 hours for a base landing page), we refund 20% of the price.
- Refund before design approval: until the design is approved you may cancel the project with a 100% refund of the prepayment.
- 6-month warranty: we fix defects in delivered functionality free of charge for 6 months after delivery.
- Lead databases: data is collected at order time, not from stale dumps; a free 50-row sample is available before purchase to judge the quality.
5. Refunds for lead databases
A lead database is a digital good: no refund is available after delivery, with these exceptions:
- Data not delivered within 3 business days of payment — full refund.
- Fewer records than ordered — a data top-up or a pro-rata refund of the difference.
- The bounce guarantee applies only with the paid email-validation add-on: more than 5% hard bounces within 7 days of delivery, backed by a mailing log — replacement records or a partial refund.
The default remedy is additional data or a re-scrape, not a monetary refund.
6. Data usage terms
- Data is compiled from publicly available sources — public directories and company websites. Emails are included where publicly available.
- Upon delivery the buyer becomes an independent data controller and is responsible for complying with GDPR, ePrivacy, CAN-SPAM and Ukrainian law when using the data.
- Prohibited: spam mailings, resale or transfer of the data to third parties, and discriminatory profiling.
- Data is provided as is beyond the replacement policy in section 5. We are not affiliated with Google. The buyer indemnifies us against claims caused by their breach of these terms. This document is not legal advice.
